Sourcerer Terms of Service

Welcome to Sourcerer. These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "User") and Sourcerer Events, LLC. ("Sourcerer," "we," "us," or "our"), governing your access to and use of the Sourcerer platform, including our website at sourcerer.live, mobile applications, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use immediately.
1. Acceptance of Terms
By creating an account, accessing, browsing, or otherwise using Sourcerer, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms or policies referenced herein. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of the Service
Sourcerer is an event discovery platform that aggregates and displays event information from publicly available sources. Our services include, but are not limited to:
- A location-based map of events
- Event details, previews, and personalized recommendations
- Artist enrichment via third-party integrations (e.g., Spotify, YouTube)
- Venue mapping and directions via Google Maps
- User-submitted venue URLs and event-related content
Sourcerer does not own, create, host, produce, or sell tickets to any events unless explicitly stated. Event information displayed on Sourcerer is aggregated from third-party sources and may not reflect real-time changes. Users should always verify event details with the official event organizer or venue.
3. Eligibility
You must be at least 17 years old (or the age of legal majority in your jurisdiction, whichever is greater) to use Sourcerer. By using the Service, you represent and warrant that you meet this requirement. We do not knowingly collect information from or direct the Service to anyone under 17.
4. User Accounts
Certain features require you to create an account via OAuth authentication (e.g., Google or Apple sign-in). By creating an account, you agree to:
- Provide accurate and complete information
- Maintain the confidentiality and security of your account credentials
- Accept full responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason.
5. Content and Licensing
5.1 Sourcerer Content
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and the compilation thereof — are the exclusive property of Sourcerer Events, LLC. or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
5.2 Third-Party Content
Sourcerer aggregates event information from multiple publicly available sources. We do not guarantee the accuracy, completeness, timeliness, or availability of any third-party content. Third-party content is provided "as is" and all trademarks, service marks, and trade names belong to their respective owners.
5.3 User-Submitted Content
When you submit content to Sourcerer (including venue URLs, event submissions, reviews, ratings, or comments), you grant Sourcerer a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media or distribution method now known or later developed, for the purpose of operating, promoting, and improving the Service.
You represent and warrant that you own or have the necessary rights, licenses, and permissions to submit such content and to grant the foregoing license.
5.4 Prohibited Content
Users may not post, submit, or share:
- Content that is illegal, fraudulent, false, or misleading
- Copyrighted material without proper authorization from the rights holder
- Hate speech, harassment, threats, or abusive content
- Spam, unsolicited advertising, or promotional material
- Malware, viruses, or any code designed to disrupt the Service
- Personally identifiable information of third parties without their consent
We reserve the right to remove any content that violates these Terms without notice.
6. Event Listings and Ticketing
- Sourcerer does not host, produce, or guarantee any events listed on the platform.
- We are not responsible for ticket sales, pricing, refunds, or event cancellations.
- Event details (dates, times, venues, pricing) are sourced from third parties and may be inaccurate or outdated.
- Users should always verify event details directly with the official event organizer or venue before attending or purchasing tickets.
- Attendance at any event discovered through Sourcerer is entirely at your own risk.
7. Location Services
Sourcerer uses your device's location services (with your explicit permission) to provide event recommendations and mapping features. By enabling location services, you consent to our collection and use of your approximate location data as described in our Privacy Policy.
- We use location data solely to display nearby events and provide mapping functionality.
- We do not store historical location tracking data.
- You can disable location access at any time through your device settings.
8. Third-Party Services and API Disclosures
Sourcerer integrates with the following third-party services to provide and enhance the Service. By using Sourcerer, you acknowledge and agree to be bound by the terms and privacy policies of these services:
8.1 YouTube API Services
Sourcerer uses YouTube API Services to display artist-related video content. By using Sourcerer, you agree to be bound by the YouTube Terms of Service. Please review Google's Privacy Policy for information about how Google handles your data. You may revoke Sourcerer's access to your data via the Google Security Settings.
8.2 Spotify
Sourcerer uses the Spotify Web API to display artist information, track previews, and related music content. Spotify content is provided subject to Spotify's Terms of Use and Spotify's Privacy Policy. Spotify is a third-party beneficiary of these Terms and may enforce the provisions that relate to Spotify's content and services. Sourcerer disclaims all implied warranties with respect to Spotify Platform features and content.
8.3 Google Maps Platform
Sourcerer uses Google Maps Platform for venue mapping, geocoding, and location services. Your use of mapping features is subject to the Google Maps Additional Terms of Service and Google's Privacy Policy.
8.4 Firebase (Google Authentication)
Sourcerer uses Google Firebase for account authentication. Your use of Google sign-in is subject to Google's Terms of Service and Google's Privacy Policy.
8.5 General Third-Party Disclaimer
Sourcerer is not responsible for any third-party API failures, limitations, data inaccuracies, service interruptions, changes to terms or functionality, or any other aspect of third-party services. Your use of third-party content and services accessed through Sourcerer is at your own risk and subject to the applicable third-party terms and policies.
9. Subscriptions and Paid Services
Sourcerer may offer paid features, including premium event discovery, enhanced recommendations, and venue promotion services ("Paid Services"). If you purchase Paid Services:
- You agree to pay all applicable fees at the prices in effect at the time of purchase.
- Subscriptions automatically renew unless cancelled before the renewal date.
- All fees are non-refundable except as required by applicable law.
- We reserve the right to modify pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance.
- For subscriptions purchased through the Apple App Store or Google Play, the respective platform's terms and refund policies apply.
10. Prohibited Uses
You agree not to:
- Scrape, crawl, copy, download, or otherwise repurpose event data, content, or any portion of the Service by automated or manual means
- Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service for any illegal purpose or in violation of any applicable law or regulation
- Impersonate any person or entity or falsely represent your affiliation with any person or entity
- Access or attempt to access accounts, systems, or data not intended for you
- Use the Service for commercial solicitation, advertising, or competitive intelligence without our prior written consent
11. Intellectual Property
The Sourcerer name, logo, tagline ("Curate Your World"), and all related marks are trademarks of Sourcerer Events, LLC. You may not use, reproduce, or distribute our trademarks without prior written permission. All rights not expressly granted herein are reserved.
12. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. To the fullest extent permitted by law, Sourcerer disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the foregoing, Sourcerer makes no warranty or representation that: (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) event information displayed on the Service will be accurate, complete, or current; or (d) any defects in the Service will be corrected.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOURCERER EVENTS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
In no event shall Sourcerer's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of (a) the amount you paid to Sourcerer in the twelve (12) months preceding the claim, or (b) fifty US dollars ($50.00).
Event Risks: Attending events discovered through Sourcerer is entirely at your own risk. Sourcerer is not liable for injuries, property damage or loss, disputes with event organizers or attendees, or any other harm arising from event attendance.
14. Indemnification
You agree to defend, indemnify, and hold harmless Sourcerer Events, Inc. and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, actions, demands, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any content you submit to the Service.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to conflict of law principles.
Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall take place in San Francisco County, California. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Sourcerer.
16. Termination
We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 11, 12, 13, 14, 15, and 17 survive termination.
17. General Provisions
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sourcerer regarding the Service.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer these Terms without our prior written consent. Sourcerer may assign these Terms without restriction.
18. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email, in-app notification, or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
